2. What are the contracts?
2.1. Our Intermediation Service and the Purchase of Travel Services
Through our Site, we offer a search and intermediation service of Travel Services and/or Other Services available on the market, as well as an intermediary service for the purchase of the services you select. A purchase on this Site is considered any order for Travel Services and/or Other Services made with an obligation to purchase and which has been confirmed by us.
Unless otherwise indicated, when you purchase Travel Services through this Site, it is formalised into an agreement directly with the Travel Providers.
2.1.1. We do not enter into the contractual relationship relating to the Travel Services and/or Other Services that you purchase, unless expressly indicated as such. WHEN YOU MAKE A BOOKING VIA THIS SITE, THE CONTRACT WILL BE BETWEEN THE TRAVEL Suppliers AND YOU, AND NOT BETWEEN US AND YOU UNLESS OTHERWISE INDICATED. Please note that in this case, for any claims relating to Travel Services and/or Other Services purchased, our role is just to intermediate between you and the Travel Provider who will be the last responsible.
2.1.2. We will assist you in the purchase of Travel Services and/or Other Services, intervening in your name for the procurement of said purchases with the Travel Suppliers. Your agreement is subject to the terms and conditions of each Travel Provider, who can limit or exclude its responsibility. Ensure that you consult the applicable terms and conditions of your Travel Provider/s, especially those relating to cancellation terms. See the relevant section.
2.1.3. By using this Site to purchase Travel Services, you authorise us to act as your representative during the procurement process from the corresponding Travel Provider/s, as well as for the payment of those services on your behalf, as necessary, in order to guarantee that the transaction between you and your Travel Provider/s is carried out correctly. For this reason, we will charge you our Intermediation Fees, depending on the Travel Service purchased. Your contract for this intermediary service will be between you and our eDO Company (see clause 1.2.), and it is different to your contract with the Travel Provider/s. In any event, from the beginning, the full price of the requested Travel Service will be displayed, inclusive of our Intermediation Fees. If during the booking process you wish to add other products/services, all relevant information will be displayed where the option to add them is available before starting your purchase or order with any obligation to pay.
2.1.4. Our Intermediation Fees are non-refundable. This is because they are charged for the intermediation services provided by us, which are fulfilled when the booking has been confirmed to you. Our Intermediary Fees will be refundable in the event of an error in our service.
2.2. Booking process
After you complete the booking process, you will receive an email confirming that we have received your request and are processing it. Once we have confirmed your booking with the Travel Provider/s and payment has been duly processed you will receive a confirmation email that will include our Booking Number. At such a point your contract in relation to the services ordered will come into existence. Please note that our obligation to confirm your booking will be subject to the confirmation of the Travel Provider/s and to your payment in full.
In the event that, for any reason beyond our influence, your order cannot actually be processed partially or in full, we will indicate this in the email. Please read the email carefully and do not hesitate to contact us immediately in case of doubts.
2.2.1. Your Account allows you, when logged in to manage your bookings, to contact us, etc. Your Account will be automatically created for you on our Site based on the email and full name provided by you during your first booking process. You will need to set your password by following our instructions. Alternatively, you can use the “Forgot your password?” option in the login section. If you have any problem setting your password, you can contact us. You must keep your personal information in our Account correct and accurate. You are solely responsible for the use, preservation and privacy of your Account and credentials.
2.2.2. We reserve the right to cancel your purchase in the event that we have reason to believe it is fraudulent. In these circumstances we will attempt to contact you, using the email address you provided and/or through your bank. In the event of not being able to contact you or your bank, your purchase shall be automatically cancelled.
2.2.3. We inform you that the email document through which the agreement is formalised is the confirmation email. This information, in addition to being sent to you by email, shall be filed in our records and may be accessed at any time on request.
2.2.4. All bookings made through our Site are paperless bookings and therefore you should not expect to receive any physical tickets/confirmations.
2.2.5. To manage your booking, on some occasions, we will set up a virtual email associated with the specific booking. In such instance we will provide you with all the relevant data that could be needed to handle the specific booking.
2.2.6. In relation to optional or special requests relating to any product (e.g. meals, disabled facilities, child seats etc.), we remind you that we cannot guarantee any such requests, since we only pass these requests on to the corresponding Travel Provider/s. You have to confirm with the Travel Provider whether such special requests can be fulfilled and carried out. In addition we expressly inform you that the request for any optional or special elements, concerning flight purchases, could cause a delay to the issuing of your ticket, with a consequent risk of an increase in the airline rate or of no spaces being available when the Travel Provider processes your request.
2.3. Price
The final full price of your booking shall be confirmed once the process of searching and selection has been completed and the price is available, with a breakdown of costs, before you have the option to click on “ACCEPT AND PURCHASE”.
2.3.1. In the event that any problem arises relating to your payment (for example if there is any issue with your credit card, if the airline publishes a wrong fare, etc), we will inform you within forty-eight (48) hours from your order (or within twenty-four (24) hours if you are travelling within forty eight (48) hours) and will instruct you to make the payment effective.
2.3.2. The prices are displayed with the daily calculated exchange rates and can therefore vary on a daily basis in accordance with exchange rates. Likewise, taxes will fluctuate in accordance with exchange rates. When you start a purchase, the exchange rate is fixed at that moment and shall be applied to the modifications and cancellations of all services that comprise your purchase. The currency exchange rates are established by us. In instances where you will pay later (for example a post-pay hotel booking, or we receive the price from the airline in another currency and convert it), the applicable exchange rate will be that applied by your card provider at the time of payment.
2.3.3. Certain banks or credit card issuers may charge a fee for processing a foreign transaction (for example, if you make a booking using a credit card that is issued in a different country than the travel provider's country). Your bank or credit card issuer may pass this cost on to you. We are not liable for these additional fees, and they are outside of our control.
2.3.4. All prices which are mentioned to you on our Site are inclusive of VAT (if due at all). Note that specific VAT rules are applicable to the provision of travel services, as well as the mediation regarding such services. This means that the amount of VAT included in the price of the travel services, as well as in the mediation fee (if any), depends on the destination of your travel as well as whether you are a private customer or a customer with a VAT number.
2.3.5. In rare cases, there may be a mistake in the price. Obvious pricing errors are not binding. An obvious pricing error is one with an obvious and manifest error, where it is apparent that no reasonable person would consider the price to be normal. In those circumstances, we reserve the right to cancel the booking with no penalty and refund you the amount charged. We may offer you the opportunity to keep the booking at the correct price and pay the price difference.
2.4. Payments
You can only use the payment methods as listed on our Site. No other payment methods are accepted by us (we are an online travel agency, and we certainly do not accept cheques). You will not receive any confirmation until the payment has been received. You authorise us to use such information to (i) pay the Travel Service/s and/or Other Service/s ordered, (ii) manage refunds when appropriate and (iii) pay any Post-Booking Service/s requested. In all cases, your payment details will be encrypted in a secure server, according to PCI standards.
2.4.1. In the event that your booking cannot be processed because you use an invalid payment method, we will provide you with instructions as to how to make the payment of your booking effective. If you do not provide a valid new payment method and/or follow the instructions, we will not be able to proceed with your booking and we will have no liability in such circumstances
2.4.2. If your order includes one or more flights, be aware that some airlines will charge you directly, so payment to the airline/s and payment to us may appear as separate transactions on your bank account.
2.4.3. For security reasons, you could be requested to enter your credit or debit card information each time you make an order.
2.4.4. We may also charge you for additional fees for using certain payment methods as stated by the applicable laws, i.e. if you use a corporate card or a tripartite system (American Express or Diners). Please note that our systems automatically detect the payment method which is actually used by you and the corresponding additional fees are charged, if any. Please note that, If you pay with a credit or debit card which is held by another person than you, we will assume that you have previously requested the permission of the card holder. We reserve the right to send e-tickets, confirmations, e-vouchers and other travel documents exclusively to the card holder.
2.4.5. Where you provide us with the details of your credit card or debit card to make your booking, you authorise us to use these details to make the booking on your behalf. PAYMENT DETAILS ENTERED MUST BELONG TO YOU. BY ENTERING THE PAYMENT DATA, YOU DECLARE THAT YOU HAVE THE RIGHT TO USE THEM AND ACCEPT SOLE RESPONSIBILITY FOR DOING SO.
2.4.6. The cancellations and refunds depend on the fare rules and timing of the Travel Providers. For this reason please contact us before requesting a chargeback, otherwise we reserve the right to dispute it.
2.4.7. If you want to request an invoice, we recommend that you do so during the booking process by selecting the appropriate option, so that you can enter all the details. If you do not, you can still request the invoice later, but it cannot be addressed to a company and it will only show the name of the first passenger and the address provided. In both cases, once the invoice has been issued, the data cannot be changed. Due to tax regulations we cannot modify the details on your invoice once it has been raised. Changes would imply the cancellation of your booking, incurring cancellation costs and the risk of rebooking at a higher price. Should you need proof of your purchase, you can use your confirmation email which contains full details of all items purchased and price paid. You can also find all the payment details of your booking in your Account.
3. Terms and Conditions relating to Travel Services
The Travel Services provided on this Site are made available by eDO Companies and our providers. You can find the information about your Travel Services in the relevant section below and the complete eDO companies data at clause 1.2.2.
You can find further information about these in our Help Center .
3.1. Changes, cancellations, refunds
THE CHANCE TO CHANGE, CANCEL AND/OR REFUND a Travel Service purchased through this Site, as well as the way to do so, WILL DEPEND ON THE TERMS AND CONDITIONS OF THE RELEVANT TRAVEL SUPPLIER, WHICH ARE USUALLY ACCORDING TO THE SORT OF FARE CHOSEN. For example, if you need to correct a mistake in a passenger's name, the rules of the relevant airline will apply. If you wish to ask for a change, cancellation or refund through us, please contact us through your Account. You will also be able to resolve questions you may have through our Chatbot or our Help Centre. These requests cannot be processed by email due to the nature of the processes.
3.1.1. We can assist you to find out whether your fare allows changes or cancellation and, if you wish, we can also manage your request with your Travel Supplier/s. IF YOUR BOOKING CAN BE CANCELLED OR MODIFIED, WE CAN MANAGE YOUR REQUEST ON YOUR BEHALF SUBJECT TO OUR INTERMEDIATION FEE UP TO SIXTY (60) EURO/US DOLLARS/POUNDS/OR OTHER CURRENCY DEPENDING ON THE SITE MARKET, PER PERSON AND BOOKING AFFECTED. Please note that our Intermediation Fee for managing changes and/or cancellations does not include the amounts eventually charged by your Travel Supplier/s, according to their terms and conditions. IF THE FLIGHT CANNOT BE CHANGED OR CANCELLED (IN THE CASE OF MOST LOW-COST FARES) WE CANNOT MANAGE ANY REQUEST ON YOUR BEHALF AND NO INTERMEDIATION FEE WILL BE CHARGED.
3.1.2 Our Intermediation Fee charged at the time of booking is non-refundable. This is because it is charged for the intermediation service provided by us, which is fulfilled when the booking has been confirmed to you. Other services (such as travel insurance, guarantees, etc.) are non-refundable according to their specific terms and conditions.
3.1.3. In the event of a flight change or cancellation by the airline, please contact us and choose an alternative solution either via our Site or by calling us. Should you fail to contact us, by accepting these GT&Cs, YOU AGREE TO AUTHORISE US TO CLAIM THE REFUND OF THE CHANGED OR CANCELLED TICKET FROM THE AIRLINE. FOR THIS SERVICE, WE WILL APPLY AN INTERMEDIATION FEE OF UP TO THIRTY (30) Euro/Us dollars/Pounds/or other currency depending on the Site market, per passenger. FOR THE SAKE OF CLARITY, IF THE TICKET PRICE IS LESS THAN OR EQUAL TO THE MENTIONED AMOUNT NO INTERMEDIATION FEE WILL BE APPLIED. Low cost fares usually do not allow for cancellations or modifications and so there is no intermediation service provided or Intermediation Fee applicable in those circumstances.
3.1.4. In some other cases (such as Prime benefits, flights with the “free re-booking” label, etc.), our Intermediation Fees are also not due.
3.2. Flights
Our “Flights” intermediation and booking service is provided by Vacaciones eDreams SL. We act as an intermediary between you and the Travel Suppliers, so the travel contracts for flights booked through our Site shall be with the relevant airline/s and subject to their terms and conditions.
You can find here all the information that you will need to plan your trip (transportation conditions, baggage policy, etc.) from the airlines most frequently booked on our Site. Please be aware that this information is managed directly by the airlines and it’s important that you familiarise yourself with these policies while planning your trip. If the airline you are flying with is not listed, please consult the conditions directly on the airline’s website.
3.2.1. WHEN YOU MAKE A FLIGHT BOOKING VIA THIS SITE, THE CONTRACT OF TRANSPORT IS BETWEEN THE AIRLINE AND YOU, AND NOT BETWEEN US AND YOU. Any problems arising from the contract of carriage (delays, schedule changes, cancellations, refunds, fare rules, loss of baggage, etc.), and the related obligations and liability, sit directly with the airline, and not with us. In such cases there is no liability of the intermediary, including joint and several liability.
3.2.2. Every airline has its own rules and procedures and we would urge you to check these regulations before getting to the airport. In any event, we recommend you always have a printed copy of your Confirmation Email containing your flight booking reference number(s), even though not all airlines request to see it. Some low cost airlines apply extra charges if you do not print and show your boarding pass at the airport. We recommend that you read all booking confirmation email specifications. You may need to check in and reprint your boarding pass again if your flight or passenger details change carefully.
3.2.3. In some cases, in order to provide special return fares, our search+combine tech combines one-way flights and different airlines. This means that you will have two separate bookings (one for your outbound flight and one for your inbound flight) and each booking will have its own fare rules. If you need to cancel one of the flights, it is possible to keep the other. Any cancellations, schedule changes or other modifications to one of the flights will not affect the other flight, and the fare rules of the other flight will still apply. For example, if you cancel one of the flights, the other airline is not obliged to refund the other part of the journey and offer you a change of itinerary. You may incur costs of any change with the other flight if it is necessary.
3.2.4. You should check with the relevant embassy about passport and visa requirements well in advance of travel. It is your responsibility to be in possession of a valid passport and, if appropriate, a visa. Under no circumstances will we be held responsible if you do not have the correct travel documents.
3.2.5. Every destination has its own requirements concerning entry formalities including visas, vaccinations, etc. and these may also vary depending on the nationality of the passenger. We recommend that you obtain this information before planning your trip. We cannot be held responsible under any circumstances for incidents deriving from you being non-observant of these official requirements.
3.2.6. In some cases, the refunds of the airline tickets will be received by us and passed on to you. Please note that after due receipt of the refund and all relevant and valid information relating to it, we will transfer it back to you within 7 days (the accounting between bank entities may take an additional 2-3 days).
3.3. Hotels
Our standalone “Hotel” intermediation and booking service is provided by our eDO Company Engrande SL.
When your accommodation booking through our Site is not managed directly by us, the contract of accommodation is between the Travel Provider and you, and not between us and you. Any problems arising from the contract of accommodation (reservation status, cancellations, refunds, etc.), and the related obligations and liability, fall directly on the Travel Supplier, and not on us. In such cases there is no liability of the intermediary, including joint and several liability.
3.3.1. You can find here and/or here all the information that you will need to plan your trip (structure description, address, check-in policy, etc.) from the Travel Suppliers most frequently booked on our Site. Please be aware that this information is managed directly by the Travel Providers, and it’s important that you familiarise yourself with these policies while planning your trip.
3.3.2. Every Travel Supplier has its own rules and procedures and we would urge you to check these regulations before starting your trip. In any event, we recommend you always having a printed copy of your Confirmation Email containing your booking reference number, although not all Travel Providers request to see it. We recommend that you read carefully all booking confirmation email specifications.
3.3.3. In some cases, the refunds of the Travel Suppliers will be received by us and passed on to you. Please note that after due receipt of the refund and all relevant and valid information relating to it, we will transfer it back to you within 7 days.
3.4. Flight+Hotel, Package Travel or Other Travel Service Combinations
Our “Flight+Hotel” search and booking service is provided by Vacaciones eDreams SL.
In the EU, if you contextually book a combination of two or more Travel Services for the same trip or holiday (for example Flight+Hotel, Train+Hotel, etc) at a single point of sale with the conditions included in the Directive (EU) 2015/2302, your booking is considered a Package Travel within the meaning of the mentioned Directive and you will therefore enjoy all the rights that apply to Package Travel within the EU framework.
In all other countries where Directive (EU) 2015/2302 does not apply, or when the combination of Travel Services is not considered a Package Travel according to the aforementioned EU Directive, each travel contract of the combination booked through our Site shall be with each relevant Travel Provider and subject to their terms and conditions. You can find more information in the specific sections of each Travel Service that constitutes your booking.
3.4.1. In the EU, when according to the Directive (EU) 2015/2302 your booking is considered a Package Travel, we act as the organiser and these are our special Travel Packages’ Terms and Conditions .
3.4.2. In other cases if, after selecting and paying for a Travel Service, you book additional Travel Services for your trip or holiday, you will NOT benefit from rights applying to packages under Directive (EU) 2015/2302. Therefore, we will not be responsible for the proper performance of the individual Travel Services. In the event of any problems relating to your booking please contact the relevant Travel Supplier.
3.4.3. However, within the EU, if you book with a third party any additional Travel Service offered in our Site, in a confirmation email or any other commercial communication during the next 24 hours after the reception of the confirmation email, the Travel Services will become part of a linked travel arrangement and you will not benefit from rights applying to packages under Directive (EU) 2015/2302. In that case we have, as required by EU Directive, protection in place to refund your payments to us for services not performed because of our insolvency. Please note that this does not provide a refund in the event of the insolvency of the relevant service provider.
3.5. Trains
Our “Trains” search and booking service is provided by Vacaciones eDreams SL. We act as an intermediary between you and the Travel Suppliers, so the travel contracts for trains booked through our Site shall be with the relevant railway company and subject to their terms and conditions.
You can find here all the information that you will need to plan your trip (transportation conditions, baggage policy, etc.) from the railway companies most frequently booked on our Site. Please be aware that this information is managed directly by the railway companies, and it’s important that you familiarise yourself with these policies while planning your trip. If the railway company you are travelling with is not listed, please consult the conditions directly on the railway company’s website.
3.5.1. WHEN YOU MAKE A TRAIN BOOKING VIA THIS SITE, THE CONTRACT OF TRANSPORT IS BETWEEN THE RAILWAY COMPANY AND YOU, AND NOT BETWEEN US AND YOU. Any problems arising from the contract of carriage (delays, schedule changes, cancellations, refunds, fare rules, loss of baggage, etc.), and the related obligations and liability, fall directly on the railway company, and not on us. In such cases there is no liability of the intermediary, including joint and several liability.
3.5.2. In some cases, the refunds of the Travel Suppliers will be received by us and passed on to you. Please note that after due receipt of the refund and all relevant and valid information relating to it, we will transfer it back to you within 7 days.
3.6. Cars
Our “Cars” search and booking service is directly supplied by our Travel Provider. So the travel contract for cars booked on our Site shall be with the relevant rental car company and subject to their terms and conditions.
You can find here all the information that you will need to plan your trip (pick-up and drop-off conditions, driver requirements, optional extras, etc.). Please be aware that this information is managed directly by the Travel Provider, and it’s important that you familiarise yourself with these policies while planning your trip.
3.6.1. WHEN YOU MAKE A CAR BOOKING VIA THIS SITE, THE CONTRACT OF RENTAL IS BETWEEN THE CAR RENTAL COMPANY AND YOU, AND NOT BETWEEN US AND YOU. Any problems arising from the contract of rental (late drop-off, insurance coverage, refunds, etc.) and the related obligations and liability, fall directly on the rental company, and not on us. In such cases there is no liability of the intermediary, including joint and several liability.
3.6.2. All drivers must be in possession of a valid driving licence at the moment of collecting the vehicle. The driving licence must be at least 12 months old. You must also present a credit card as a guarantee for any damage caused to the vehicle during the rental period. It is your responsibility to ensure that there are sufficient funds available on your credit card to comply with the Travel Provider's terms and conditions. Any non-compliance with any of these requirements will invalidate the vehicle hire agreement and we will not be held responsible for the subsequent loss of costs this could incur.
3.7. Travel Insurance
We recommend you take out Travel Insurance for any trip or holiday, especially for circumstances for which the Travel Provider/s has no liability. If you decide to purchase Travel Insurance through our Site, your insurance contract will be formalised directly between you and the insurance company, in accordance with the terms and conditions of the insurance policy booked, which will be available to you during the booking process and in the confirmation email.
3.7.1. When you purchase Travel Insurance, you conclude two separate contracts: (a) one agreement between you and the insurance company, which relates to the supply of Travel Insurance, subject to the terms and conditions which are mentioned in the insurance policy and (b) a separate contract between you and us, which relates to the mediation service regarding the supply of the Travel Insurance by the insurance company. We will charge you the insurance premium plus applicable insurance premiums taxes (if any) on behalf of the insurance company and a fee for the mediation service. In any event , you will have access to the insurance policy before being bound by a contract or a payment obligation. We recommend that you carefully read the insurance summary and the terms and conditions of your insurance policy.
3.7.2. The Travel Insurance costs are non-refundable. This is because they are charged for the insurance services provided by the insurance company, which are fulfilled when the booking has been confirmed to you.
4. Terms and Conditions relating to Other Services
Through our Site, in addition to the Travel Services indicated in the above section, we may also offer Other Services.
4.1. The Other Services
The Other Services provided on this Site are made available by eDO Companies or directly by other providers. In these cases you will have access to all the necessary information and the specific terms and conditions of your Other Services during the booking process, before finalising your request.
